New York State has a Cell Phone Law that says:
What is the law on cell phone use while you operate a vehicle in NYS?New York State has passed a law that does not allow you to use a hand-held mobile telephone while you drive. If you use a hand-held mobile telephone while you drive, except to call 911 or to contact medical, fire or police personnel about an emergency, you can receive a traffic ticket and pay a maximum fine of $100 and mandatory surcharges of $50.
This violation is not a probationary license violation, and the DMV does not assign any driver violation points.

So I guess he was on the phone with a fellow police officer talking about an emergency. I'll assume that.
In any event, I am a strong believer by teach by example. I just expect a NYPD cop to use a headset of some sort when chatting on his cell, even if its an emergency. I also get annoyed when I see cops turn without using a signal - no excuse for that, imo.

I can relate to this one. Not long ago, I saw a police car driven by an officer who did not fasten his seat belt. I don't have the photo though and I haven't cited any law violated, but I guess nobody is excused from the law. (Except for ambulance drivers, firemen & police who drive on the opposite lane.)
